Accessory Dwelling Units (ADU) FAQ Sheet

The Village of Croton-on-Hudson recently updated its regulations related to Accessory Dwelling Units (ADUs). The Village encourages all property owners who have an existing ADU or are interested in adding an ADU to their property to review the FAQ below:

 
What is an ADU?
An ADU is a self-contained portion of a single-family dwelling, or an accessory structure, used as a secondary housing unit independent of the primary dwelling unit.

What types of ADUs are permitted in the Village of Croton-on-Hudson?
Both accessory apartments and accessory structures (also known as accessory cottages) are permitted in residential districts, subject to Village approval. ADUs must be a minimum of 300 square feet and no greater than the lesser of 800 square feet or, in the case of an accessory apartment, 40% of the habitable floor area of the building it is located in. The owner of the property must occupy either the primary dwelling unit or the ADU as their primary residence. There is a maximum of one ADU per single-family home. 
 
How do I apply to build or legalize an ADU?
ADUs must comply with all accessory dwelling regulations in the Village Code. Applicants who comply with Village requirements can seek permits through the Village Engineering Department. Applicants should submit an application for an Accessory Apartment Permit, which must be reviewed and approved by the Village Planning Board. After Planning Board approval, applicants should follow the process for obtaining a Building Permit and Certificate of Occupancy through the Engineering Department. The Village Board has temporarily waived penalties for existing construction undertaken without an Accessory Apartment Permit for the period of January 11, 2024, through April 12, 2024. After this amnesty period, noncompliant accessory dwelling units will be subject to enforcement action, and a penalty fee will be applied if a property owner seeks to legalize the construction of a noncompliant ADU.
 
Does parking need to be provided?
No additional parking is mandatory for an accessory apartment or accessory cottage, however, the Planning Board has the authority to make parking assessments on a case-by-case basis during review of the application. Properties with an ADU will not be eligible for seasonal hardship permits unless a permit was granted prior to November 1, 2023.
 
Can an approved ADU transfer over to a new property owner?
If ownership changes, and the new owners wish to use the accessory apartment or cottage, the Engineering Department must be notified within 90 days to confirm compliance with law.

 

What is the Plus One ADU Program in Croton-on-Hudson?
The Plus One ADU (Accessory Dwelling Unit) program in Croton-on-Hudson is a housing initiative launched in partnership with Habitat for Humanity and the Housing Action Council. The program helps homeowners build ADUs, such as backyard cottages or separate-entry apartments, on their property. It aims to expand affordable housing options, enabling homeowners to stay in their homes while contributing to the local housing supply. Eligible homeowners can receive financial assistance, including grants of up to $125,000, funded by New York State Homes and Community Renewal. The program is designed to support seniors, young families, and others in need of stable housing options. It also encourages community growth and is available in several communities across Westchester County.
