Adopted Changes to NYS Building Code
On July 27, 2025, the State Fire Prevention and Building Code Council (the “Code Council”) adopted rules that amended and updated the New York State Uniform Fire Prevention and Building Code (the “Uniform Code”) and the State Energy Conservation Construction Code (the “Energy Code”).
The Department of State, acting on behalf of the Code Council, filed Notices of Adoption of these rules. The Notices of Adoption appears in the October 1, 2025 edition of the State Register. On and after October 1, 2025, the October 1, 2025 edition of the State Register can be viewed by clicking the "October 1" link at https://dos.ny.gov/state-register.
The rules will become effective on December 31, 2025.
Uniform Code: The rule adopted by the Code Council on July 25, 2025 repealed the 2020 edition of the Uniform Code and adopted an amended and updated edition of the Uniform Code. The amended and updated edition of the Uniform Code incorporated, by reference, the following publications:
- 2025 Residential Code of New York State
- 2025 Building Code of New York State
- 2025 Plumbing Code of New York State
- 2025 Mechanical Code of New York State
- 2025 Fuel Gas Code of New York State
- 2025 Fire Code of New York State
- 2025 Property Maintenance Code of New York State
- 2025 Existing Building Code of New York State
Effective Date: The effective date of the 2025 NYS Uniform Code is December 31, 2025. In addition, the Code Council voted to provide that, during the transition period between the publication of the Notice of Adoption and the effective date of the 2025 NYS Uniform Code, a person shall have the option of complying with either the provisions of the 2025 Uniform Code or the 2020 Uniform Code. Beginning on December 31, 2025, regulated parties submitting building permit applications are required to comply with the 2025 NYS Uniform Code.
Energy Code: The rule adopted by the Code Council on July 27, 2025 repealed the 2020 edition of the Energy Code and adopted an amended and updated edition of the Energy Code. The amended and updated edition of the Energy Code incorporated, by reference, the following publications:
2025 Energy Conservation Construction Code of New York State (publication date: July 2025)
NYS ASHRAE 90.1-2025 – NYS version of the Energy Standard for Buildings Except Low-Rise Residential Buildings ("NYS ASHRAE 90.1-2025")
Effective Date: The effective date of the modifications to Part 1240 is December 31, 2025. There is no transition period. Beginning on December 31, 2025, regulated parties submitting building permit applications will be required to comply with the 2025 ECCCNYS and NYS ASHRAE 90.1-2025.
Parts 1264 and 1265: 19 NYCRR Part 1264 includes provisions relating to placement of signs or symbols on commercial buildings that utilize truss type construction. 19 NYCRR Part 1265 includes provisions relating to placement of signs or symbols on residential buildings that utilize truss type, pre-engineered wood or timber construction. Parts 1264 and 1265 included references to the 2020 NYS Code Books. Because the rule that amended the Uniform Code replaced the 2020 NYS Code Books, the rule amending the Uniform Code, adopted by the Code Council on July 25, 2025, included corresponding changes to Parts 1264 and 1265. The rule made no substantive changes to Part 1264 or Part 1265.
Effective Date: The effective date of the amendments to Parts 1264 and 1265 is December 31, 2025. There is no transition period.
